संख्या- 519 / VIII-1 / 2026-09(श्रम)2018 देहरादून, 30 अप्रैल, 2026 चूंकि राज्य सरकार का समाधान हो गया है कि लोक हित में ऐसा करना आवश्यक और समीचीन है; और चूंकि सामाजिक सुरक्षा संहिता, 2020 की धारा 154 व धारा 156 में प्रावधान है कि समुचित सरकार (राज्य सरकार) एवं राज्य सरकार को उक्त संहिता के उपबंधों को कार्यान्वित करने के लिए, राजपत्र में अधिसूचना द्वारा और पूर्व प्रकाशन की शर्तों के अधीन रहते हुए नियम बनाने की शक्ति प्राप्त है; अतएव, अब राज्यपाल सामाजिक सुरक्षा संहिता, 2020 की धारा 154 व धारा 156 द्वारा प्रदत्त शक्ति का प्रयोग करते हुए उत्तराखण्ड के संगठित या असंगठित या किन्हीं अन्य क्षेत्रों के सभी कर्मचारियों/कर्मकारों के सामाजिक सुरक्षा से सम्बंधित सभी आनुषांगिक मामलों को विनियमित करने हेतु निम्नलिखित उत्तराखण्ड सामाजिक सुरक्षा संहिता नियमावली, 2026 बनाने का प्रस्ताव करते है;

राज्यपाल उक्त संहिता की धारा 154 की उपधारा (1) एवं धारा 156 की उपधारा (1) के अधीन यह भी निर्देश देते हैं कि उक्त नियमावली से प्रभावित होने वाले हिताधिकारियों एवं जनसामान्य द्वारा इस अधिसूचना से सम्बन्धित कोई भी अप्यावेदन एवं आपत्तियां इस अधिसूचना के समाचार पत्र/वेबसाइट में प्रकाशित होने की दिनांक से 45 दिन के भीतर सचिव, श्रम विभाग, उत्तराखण्ड शासन, 4 बी सुभाष रोड, उत्तराखण्ड सचिवालय, देहरादून, उत्तराखण्ड (secretaryswpl25@gmail.com) एवं श्रम आयुक्त, उत्तराखण्ड (lcukhld0@gmail.com) को प्रेषित किये जा सकेंगे; राज्यपाल यह भी निदेश देते हैं कि उक्त समायावधि के पश्चात् किसी भी अस्थावेदन एवं अपत्तियों को स्वीकार नहीं किया जायेगा।

उत्तराखण्ड सामाजिक सुरक्षा संहिता नियमावली, 2026

अध्याय 1

प्रारंभिक

संक्षिप्त नाम, विस्तार और प्रारंभ

• 1. (1) इस नियमावली का संक्षिप्त नाम उत्तराखण्ड सामाजिक सुरक्षा संहिता नियमावली, 2026 है।
• (2) इसका विस्तार संपूर्ण उत्तराखण्ड राज्य पर होगा।
• (3) ये सरकारी राजपत्र में उसके अंतिम प्रकाशन होने की तिथि से प्रवृत्त होगी। परिभाषाएं
• 2. (1) जब तक कि विषय या संदर्भ में कोई भी बात प्रतिकूल न हो, इस नियमावली में-
• (क) “प्राधिकारी” से राज्य सरकार द्वारा निर्दिष्ट प्राधिकारी अभिप्रेत है;
• (ख) “मूल्यांकन करने वाले अधिकारी” से राज्य सरकार का कोई राजपनित्र अधिकारी या स्थानीय प्राधिकरण का कोई अधिकारी जो राज्य सरकार के राजपनित्र अधिकारी के समतुल्य हो जिसे राज्य सरकार द्वारा संहिता के तहत उपकर के मूल्यांकन के लिए नियुक्त किया गया है, अभिप्रेत है:
• (ग) "कम्पनी" से कम्पनी अधिनियम, 2013 की धारा 2 में यथा परिभाषित कोई कम्पनी अभिप्रेत है;
• (घ) “सक्षम प्राधिकारी” से यथा स्थिति राज्य सरकार द्वारा सक्षम प्राधिकारी के रूप में यथा स्थिति सामाजिक सुरक्षा संहिता, 2020 की धारा 58 या धारा 91 के अधीन नियुक्त कोई अधिकारी अभिप्रेत है;
• (ड) "सेवा का सम्पूरित वर्ष" से बारह मास की निरंतर सेवा अभिप्रेत है;

• (च) "उपकर संग्रहकर्ता" से संहिता के अधीन उपकर संग्रह के लिए राज्य सरकार द्वारा नियुक्त एक अधिकारी अभिप्रेत है;
• (ख) “अध्यक्ष” से उत्तराखण्ड असंगतित कर्मचारी सामाजिक सुरक्षा बोर्ड तथा उत्तराखण्ड भवन एवं अन्य सन्निर्माण कर्मचारी कल्याण बोर्ड के अध्यक्ष अभिमेत है;
• (झ) “संहिता” से सामाजिक सुरक्षा संहिता, 2020 (2020 का 36) अभिप्रेत है;
• (ज) "इलेक्ट्रॉनिक रूप" से संहिता के उद्देश्य के लिए किसी भी मोड में ईमेल द्वारा प्रस्तुत या निर्दिष्ट पोर्टल पर अपलोड करने या किसी भी मोड में डिजिटल भुगतान अभिप्रेत है;
• (ट) “प्रपत्र” से इस नियमावली के जुड़ा कोई प्रपत्र अनिप्रेत है;
• (द) "सरकारी प्रतिभूतियों" से सरकारी प्रतिभूति अधिनियम, 2006 में परिभाषित सरकारी प्रतिभूतियां अभिप्रेत हैं;
• (ड) "नामांकन" से संहिता की धारा 55 के अधीन किया गया नामांकन अभिप्रेत है;
• (ढ) "अनुसूची" से संहिता की अनुसूची अभिप्रेत है;
• (ग) “धारा” से संहिता की धारा अभिप्रेत है;
• (त) ‘पोर्टल’ से श्रम विभाग उत्तराखण्ड का अधिकारिक वेब पोर्टल अथवा राज्य सरकार का इस विषय हेतु संचालित वेब पोर्टल अभिप्रेत है;
• (थ) "निर्दिष्ट" से राज्य सरकार द्वारा प्राधिकृत किसी अधिकारी के आदेश द्वारा निर्दिष्ट अभिप्रेत हैं;
• (द) “वर्ष” से वित्तीय वर्ष अभिप्रेत है, जो कि एक अप्रैल से शुरू होता है और अगले वर्ष के इक्रतीस मार्च को समाप्त होता है;

• (ध) ‘राज्य सरकार’ से उत्तराखण्ड सरकार अभिप्रेत है।
• (2) शब्द और पद जो इस नियमावली में प्रयुक्त है, किन्तु परिभाषित नहीं है, उनके वही अर्थ होंगे जो सामाजिक सुरक्षा संहिता, 2020 में दिये गये हैं।

अध्याय 2

सामाजिक सुरक्षा संगठन

(क) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड

गठन की रीति

• 3. (1) राज्य सरकार द्वारा संहिता की धारा 6 की उपधारा (10) में निर्दिष्ट सदस्यों के साथ तीन वर्ष के लिए उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड का गठन किया जायेगा।
• (2) राज्य सरकार संहिता की धारा 6 की उपधारा (10) के खंड (घ) के उपखंड (i) तथा उपखंड (ii) के अधीन असंगठित क्षेत्र के कर्मचार संघों और असंगठित क्षेत्र के नियोक्ता संघों के प्रतिनिधियों में से नामांकन मांगें: परन्तु यह कि उपखण्ड (i) के अधीन नाम निर्देशित सात व्यक्तियों में अनुसूचित जाति, अनुसूचित जनजाति, अल्पसंख्यकों और महिलाओं का प्रतिनिधित्व करने के लिए प्रत्येक से एक-एक सदस्य होगा।
• (3) राज्य सरकार सिहिता की धारा 6 की उपधारा (10) के खंड (घ) के उपखंड (iii) के अधीन उत्तराखण्ड विधान सभा के अध्यक्ष से सदस्यों हेतु नामांकन की मांग करेगी।
• (4) राज्य सरकार संहिता की धारा 6 की उपधारा (10) के खंड (घ) के उपखंड (iv) के अधीन श्रम कल्याण, प्रांब्ध, वित्त, विधि और प्रशासन के क्षेत्र में प्रतिष्ठित व्यक्तियों में से पांच व्यक्तियों को नामित करेगी।
• (5) राज्य सरकार संहिता की धारा 6 की उपधारा (10) के खंड (घ) के उपखंड (v) के अधीन 10 ऐसे सदस्यों को मनोनीत करेगी, जो राज्य सरकार के ऐसे विभागों का प्रतिनिधित्व करेंगे, जो असंगठित क्षेत्र के कामगार के कल्याण से संबंधित मामलों से जुड़े हों ।

• (6) (क) राज्य सरकार, उत्तराखण्ड अंसंगठित कर्मचारी सामाजिक सुरक्षा बोर्ड का कार्यकाल समाप्त होने के छः माह पूर्व से पुनर्गठन की प्रक्रिया को प्रारंभ कर देगी।
• (ख) यदि उत्तराखण्ड अंसंगठित कर्मचार सामाजिक सुरक्षा बोर्ड का कार्यकाल समाप्त होने के पश्चात भी नए बोर्ड का गठन नहीं होता है, तो राज्य सरकार द्वारा नए बोर्ड का गठन होने तक की अवधि के लिए बोर्ड के कर्तव्यों के निर्वहन हेतु अधिसूचना के माध्यम से ऐसी व्यवस्था की जा सकेगी।
• (रा) खंड (ख) में संदर्भित व्यवस्था लागू किये जाने के पश्चात की गई सभी कार्यवाहियों का प्रभाव बिल्कुल वही होगा जैसे वे स्वयं बोर्ड द्वारा ही की गई हों। सदस्य की पदावधि
• 4. (1) उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड के पदन सदस्य से भिन्न कोई सदस्य अपने नाम निर्देशन की तारीख से तीन वर्ष से अनधिक की अवधि के लिए पद धारण करेगा। परन्तु पदेन सदस्यों के अलावा किसी भी सदस्य की पदावधि कुल दो अवधियों से अधिक के लिए नहीं होगी।
• (2) धारा 6 की उपधारा (10) के खण्ड (घ) के उपखण्ड (iii) के अधीन नाम-निर्देशित कोई व्यक्ति उत्तराखण्ड विधान सभा के सदस्य न रह जाने पर उत्तराखण्ड असंगित कर्मचार सामाजिक सुरक्षा बोर्ड का सदस्य नहीं रहेगा।
• (3) धारा 6 की उपधारा (10) के खंड (घ) के उपखंड (i) उपखंड (ii) और उपखंड (iv) के अधीन नाम-निर्देशित कोई सदस्य उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड का सदस्य नहीं रहेगा यदि वह उस प्रवर्ग का, जिससे वह इस प्रकार नाम-निर्देशित किया गया था, का प्रतिनिधित्व नहीं करता है। त्याग पत्र
• 5. (1) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड का कोई सदस्य, जो पदेन सदस्य नहीं है, राज्य सरकार

को संबोधित स्व-हस्तलिखित पत्र द्वारा अपने पद का त्याग कर सकेगा।

• (2) ऐसे सदस्य का स्थान उसके त्यागपत्र स्वीकार होने की तारीख से या त्यागपत्र की सूचना की प्राप्ति की तारीख से तीस दिन के अवसान के पश्चात, जो भी पूर्वतर हो, रिक्त हो जायेगा ।
• (3) सदस्य के त्यागपत्र को स्वीकार करने की शक्ति राज्य सरकार में निहित होगी। त्यागपत्र स्वीकृत के पश्चात् सदस्य-सचिव द्वारा उत्तराखण्ड असंगठित कर्मचारी सामाजिक सुरक्षा बोर्ड को उसके अगले अधिवेशन में प्रस्तुत किया जायेगा। पते में परिवर्तन
• 6. यदि कोई सदस्य अपने पते में परिवर्तन करता है तो वह अपना नया पता उत्तराखण्ड अंसंगठित कर्मचार सामाजिक सुरक्षा बोर्ड के सदस्य सचिव को अधिसूचित करेगा, जो तदोपरांत उसका नया पता सरकारी अभिलेखों में दर्ज करेगा: परन्तु यह कि यदि सदस्य अपना नया पता अधिसूचित करने में असफल रहता है, तो सरकारी अभिलेखों में अंकित पता सभी प्रयोजनों के लिए सदस्य का सही पता समझा जायेगा। सदस्य की निर्हत्ता और हटाया जाना
• 7. (i) किसी भी व्यक्ति को उत्तराखण्ड असंगठित कर्मचारी सामाजिक सुरक्षा बोर्ड का सदस्य नहीं चुना जाएगा अथवा वह उत्तराखण्ड असंगठित कर्मचारी सामाजिक सुरक्षा बोर्ड का सदस्य नहीं बना रहेगा, यदि ऐसा व्यक्ति धारा 8 के किसी प्रावधान के अंतर्गत आता है।
• (2) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के किसी सदस्य को हटाने हेतु धारा 8 की उपधारा (2) के खण्ड (ख) व (ग) के अधीन, यदि कोई कार्यवाही चल रही हो, तो उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के ऐसे सदस्य को हटाने के लिए कार्यवाही लंबित रहने के दौरान, ऐसा सदस्य बोर्ड की बैठकों से अनुपस्थित रहेगा।
• (3) धारा 8 के अधीन किसी सदस्य को प्रतिबंधित करने, अयोग्य घोषित करने और हटाने के संबंध में राज्य सरकार का निर्णय अंतिम होगा।

रिवत स्थानों को भरने की रीति

• 8. यदि उत्तराखण्ड अंसंगठित कर्मकार सामाजिक सुरक्षा बोर्ड की सदस्यता में कोई रिश्ता होती है या होने की संभावना है तो सदस्य सचिव, राज्य सरकार को रिपोर्ट प्रस्तुत करेगा और ऐसी रिपोर्ट प्राप्त होने पर राज्य सरकार अधिसूचना द्वारा, रिक्त स्थान को भरने के लिए किसी व्यक्ति को नाम-निर्देशित कर सकेगी और इस प्रकार नाम निर्देशित व्यक्ति उस सदस्य की शेष पदावधि तक, जिसके स्थान पर वह नाम-निर्देशित किया जाता है, पद धारण करेगा। सदस्यों के भत्ते
• 9. (1) उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड के किसी सरकारी सदस्य का यात्रा भत्ता, उनके द्वारा शासकीय कर्तव्य के लिए की गई यात्राओं पर लाभु नियमों के अनुसार होगा और उनका भुगतान उनके वेतन का संदाय करने वाले प्राधिकारी द्वारा संदत किया जायेगा।
• (2) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के गैर सरकारी सदस्यों को बोर्ड के बैठकों में भाग लेने के लिए यात्रा भत्ता ऐसी दरों पर संदत किया जायेगा, जैसा राज्य सरकार द्वारा समय-समय पर नियत किया जाए। बोर्ड के कृत्य
• 10. उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड द्वारा संहिता की धारा 9 की उपधारा 15 में उल्लिखित कृत्यों का पालन किया जायेगा। कारबार का निपटान
• 11. ऐसे प्रत्येक विषय पर, जिस पर उत्तराखण्ड आसंगतित कर्मचारी सामाजिक सुरक्षा बोर्ड द्वारा विचार किया जाना है, बोर्ड की किसी बैठक में या यदि अध्यक्ष ऐसा निर्देश देता है तो प्रत्येक सदस्य की राय जानने के लिए आवश्यक कागजात भेजकर विचार किया जाएगा और उस विषय का बहुमत के विनिश्चय के अनुसार निपटारा किया जायेगा; परन्तु यह कि जहां किसी विषय पर मतैक्य नहीं है और बोर्ड के सदस्य समान रूप से विभाजित हैं, अध्यक्ष का द्वितीय और निर्णायक मत होगा। बैठक
• 12. (1) उत्तराखण्ड अंसंगदित कर्मकार सामाजिक सुरक्षा बोर्ड की बैठक ऐसे स्थान और ऐसे समय पर होगी, जो अध्यक्ष द्वारा विनिश्चित किये जाएं।

• (2) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड की तीन मास में कम से कम एक बार बैठक होगी।
• (3) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड का अध्यक्ष, जब भी उचित समझे तथा बोर्ड के कम से कम आधे सदस्यों के लिखित अनुरोध प्राप्त होने पर पद्धत दिनों के भीतर एक विशेष बैठक बुलाएंगे तथा इस प्रकार किये गए अनुरोध में इस प्रकार प्रस्तावित बैठक किए जाने का उद्देश्य उल्लिखित होगा। बैठक की अध्यक्षता
• 13. (1) उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड का अध्यक्ष बोर्ड की बैठक की अध्यक्षता करेगा।
• (2) अध्यक्ष की अनुपस्थिति में उपाध्यक्ष द्वारा बैठक की अध्यक्षता की जायेगी। अध्यक्ष और उपाध्यक्ष की अनुपस्थिति में अध्यक्ष द्वारा नामित सदस्य द्वारा बैठक की अध्यक्षता की जाएगी। बैठक की सूचना और कार्य सूची
• 14. (1) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड की प्रत्येक साधारण बैठक का नोटिस, जिसमें इस दिनांक, समय व स्थान उल्लिखित हो, बैठक में की जाने वाली प्रस्तावित कार्यवाहियों की एक सूची सहित, बोर्ड के अध्यक्ष द्वारा अनुमोदित किये जाने के पश्चात जारी होने की तिथि से पंद्रह दिनों के अंदर बोर्ड के सदस्यों को ई-मेल अथवा पंजीकृत डाक या विशेष संदेशवाहक के माध्यम से भेजा जायेगा तथा इसके पश्चात यथाशीघ्र कार्यसूची की प्रत्येक मद पर एक संक्षिप्त टिप्पणी कार्यसूची के साथ प्रत्येक सदस्य को भेजी जाएगी।
• (2) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के अध्यक्ष किसी भी मामले पर विचार के लिए, जो उसकी राय में अति आवश्यक है, की आकस्मिक बैठक बुलाता है, तो ऐसा यथोचित समय जिसे वह आवश्यक समझे नोटिस देने के लिए पर्याप्त समझा जाएगा एवं बोर्ड के सदस्य को ई-मेल अथवा पंजीकृत डाक या विशेष संदेशवाहक द्वारा भेजा जायेगा।
• (3) बोर्ड के बैठक के लिए कार्यालय की सूची में सम्मिलित कार्यालय के सिवाय, किसी कार्यालय पर अध्यक्ष की अनुज्ञा के बिना विचार नहीं किया जायेगा।

गणपूर्ति

• 15. उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड के किसी बैठक में तब तक कोई कार्यालय का संव्यवहार नहीं किया जायेगा जब तक उस बैठक में कम से कम एक चौथाई सदस्य उपस्थित न हों; परन्तु यदि किसी बैटक में निर्धारित गणपूर्ति से कम सदस्य उपस्थित है तो अध्यक्ष द्वारा बैटक को एक घंटे के लिए स्थगित किया जायेगा और उसके बाद ऐसी स्थगित बैटक में उपस्थित सदस्यों की संख्या पर ध्यान दिए बिना कार्य का निपटान तैय होगा। अशिक्रमण एवं पुनर्गठन 16.
• (1) यदि उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड अपने कृत्यों का पालन करने में असमर्थ है या अपने कृत्यों के निवर्धन में बार-बार विलंब करता है या अपनी शक्तियों अथवा अधिकारिता को पार करता है या उनका दुरुपयोग करता है, तो राज्य सरकार अधिसूचना द्वारा उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड का अधिक्रमण कर सकेनी: परन्तु अधिक्रमण की अधिसूचना जारी किये जाने से पूर्व राज्य सरकार द्वारा उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड को युक्ति युक्त अवसर प्रदान किया जायेगा और उसके द्वारा दिए गए स्पष्टीकरणों और किए गए आलोचनों पर विचार किये जाने के पश्चात् समुचित कार्यवाई की जायेगी
• (2) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के अधिक्रमण के पश्चात् एवं उसके पुनर्गठन किये जाने तक राज्य सरकार द्वारा स्थिता के सुसंगत प्रावधानों के प्रशासन के उद्देश्य से केन्द्रीय सरकार द्वारा निर्धारित वैकल्पिक व्यवस्था की जायेगी ।
• (3) राज्य सरकार द्वारा संहिता की धारा 11 के अन्तर्गत केंद्रीय सरकार द्वारा निर्धारित रीति के तहत उत्तराखण्ड असंगठित कर्मचार सामाजिक सुरक्षा बोर्ड का पुनर्गठन किया जायेगा।
• (4) उत्तराखण्ड असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड के अधिक्रमण की कार्यवाही और उसके अधिक्रमण के लिए होने वाली परिस्थितियों की पूरी रिपोर्ट राज्य विधान सभा के समक्ष अधिक्रमण की अधिसूचना की तारीख के तीन माह के अन्दर रखी जायेगी।

• 17. (1) संहिता की धारा 7 के अन्तर्गत राज्य सरकार द्वारा निम्नानुसार उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचारी कल्याण बोर्ड का गठन किया जायेगा:-
• (क) राज्य सरकार द्वारा नाम निर्देशित अपर मुख्य सचिव/प्रमुख सचिव/सचिव, श्रम विभाग-अध्यक्ष
• (ख) केंद्रीय सरकार द्वारा नाम निर्देशित एक सदस्य।
• (ग) राज्य सरकार का प्रतिनिधित्व करने वाले राज्य सरकार द्वारा नियुक्त तीन सदस्य, जिनमें एक मुख्य निरीक्षक, भवन और संनिर्माण, एक सदस्य वित्त विभाग तथा एक सदस्य विधि विभाग का प्रतिनिधित्व करने वाला होगा, जो उप सचिव पद से अनिम्न होगा ।
• (ध) राज्य सरकार द्वारा नियुक्त तीन सदस्य जो नियोजकों का प्रतिनिधित्व करते हूं।
• (ड) राज्य सरकार द्वारा नाम निर्देशित तीन सदस्य जो भवन एवं अन्य सांनिमार्ण कर्मकारों का प्रतिनिधित्व करते हों।
• (2) नियुक्त सदस्यों में से कम से कम एक सदस्य महिला होगी। पदावधि
• 18. शासकीय सदस्यों को छोड़कर बोर्ड के सदस्यों की पदावधि नियुक्ति की तिथि से सामान्यतः तीन वर्ष होगी। त्याग पत्र
• 19. (1) उत्तराखण्ड भवन और अन्य संनिमार्ग कर्मचार क्ल्याण बोर्ड का कोई सदस्य, जो पदेन सदस्य नहीं है, राज्य सरकार को संबोधित इलेक्ट्रॉनिक मेल या पंजीकृत डाक के माध्यम से स्व-हस्तलिखित पत्र द्वारा अपने पद का त्याग कर सकेगा।
• (2) ऐसे सदस्य का स्थान उसके त्यागपत्र स्वीकार होने की तारीख से या त्यागपत्र की सूचना की प्राप्ति की तारीख से तीस दिन के अवसान के पश्चात्, जो भी पूर्व हो, रिक्त समझा जायेगा ।

• (3) सदस्य के त्यागपत्र को स्वीकार करने की शक्ति राज्य सरकार में निहित होगी। पता परिवर्तन
• 20. यदि कोई सदस्य अपने पते में परिवर्तन करता है तो वह अपना नया पता उत्तराखण्ड भवन और अन्य सन्मिर्मण कर्मचार कल्याण बोर्ड के सचिव को अधिसूचित करेगा, जो तदोपरांत उसका नया पता सरकारी अभिलेख में दर्ज करेगा: परन्तु यह कि यदि सदस्य अपना नया पता अधिसूचित करने में असफल रहता है, तो सरकारी अभिलेख में पता सभी प्रयोजनों के लिए सदस्य का सही पता समझा जायेगा। सदस्य की निर्हत्ता और हटाया जाना
• 21. (1) किसी भी व्यक्ति को उत्तराखण्ड भवन और अन्य सन्मिर्माण कर्मकार कल्याण बोर्ड का सदस्य नहीं बुना जाएगा अथवा न ही वह उत्तराखण्ड भवन और अन्य सन्मिर्माण कर्मकार कल्याण बोर्ड का सदस्य बना रहेगा, यदि ऐसा व्यक्ति धारा 8 के किसी प्रावधान के अंतर्गत आता है !
• (2) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड के किसी सदस्य को हटाने हेतु धारा 8 की उपधारा (2) के खण्ड (ख) व (ग) के अधीन, यदि कोई कार्यवाही चल रही हो, तो उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड के किसी भी सदस्य को हटाने के लिए कार्यवाही लंबित रहने के दौरान, ऐसा सदस्य बोर्ड की बैठकों से अनुपस्थित रहेगा।
• (3) धारा 8 के अंतर्गत किसी सदस्य के प्रतिबंधित करने, अयोग्य घोषित करने और हटाने के संबंध में राज्य सरकार का निर्णय अन्तिम होगा। रिवत स्थानों को भरने की रीति
• 22. यदि उत्तराखण्ड भवन और अन्य सिनिमार्ण कर्मकार क्ल्याण बोर्ड की सदस्यता में कोई रिटिक्त होती है या होने की संभावना है तो सचिव, राज्य सरकार को रिपोर्ट प्रस्तुत करेगा और ऐसी रिपोर्ट प्राप्त होने पर राज्य सरकार अधिसूचना द्वारा, रिटिक्त स्थान को भरने के लिए किसी व्यक्ति को नाम–निर्देशित कर सकेगा और इस प्रकार नाम निर्देशित व्यक्ति उस सदस्य की शेष पदावधि तक, जिसके स्थान पर वह नाम–निर्देशित किया जाता है। पद धारण कर सकेगा। सदस्यों को फीस व भत्ते
• 23. (1) उत्तराखण्ड भवन और अन्य संनिमार्ण कर्मकार कल्याण बोर्ड के किसी सरकारी सदस्य का यात्रा भत्ता सरकारी

कर्त्तव्य पर उसके द्वारा निष्पादित की गयी यात्रा के लिए उस पर लामू नियमों द्वारा शासित किया जायेगा और उसके वेतन का संदाय करने वाले प्राधिकारी द्वारा संदत किया जायेगा।

• (2) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड के गैर सरकारी सदस्यों को बोर्ड के बैठकों में उपस्थित होने के लिये यात्रा भत्ता ऐसी दरों पर संदत्त किया जायेगा, जिन्हें राज्य सरकार द्वारा समय-समय पर नियत किया जाए। बोर्ड के कृत्य

उत्तराखण्ड भवन और अन्य सांनिमार्ण कर्मचार क्ल्याण बोर्ड द्वारा संहिता की धारा 7 की उपधारा (6) में उल्लिखित कृत्यों का पालन किया जायेगा। बैठक 25.

• (1) उत्तराखण्ड भवन और अन्य संर्माण कर्मचार कल्याण बोर्ड की प्रत्येक बैठक के स्थान व समय का निर्धारण सहिता के अन्तर्गत केन्द्र सरकार द्वारा बनाये गये नियम में निर्धारित प्रावधान के अनुसार किया जायेगा।
• (2) उत्तराखण्ड भवन और अन्य संज्ञिमार्ग कर्मचार कल्याण बोर्ड की वर्ष में उत्ती बैठक होगी जितनी साहित्य के अन्तर्गत केन्द्र सरकार द्वारा बनाए गए नियम में निर्धारित किया गया है।
• (3) उत्तराखण्ड भवन और अन्य संर्निर्माण कर्मचार कल्याण बोर्ड की विशेष बैठक सहिता के अन्तर्गत केन्द्र सरकार द्वारा बनाए गए नियम में निर्धारित प्रावधान एवं रीति के अनुसार बुलायी जायेगी। बैठक की अध्यक्षता

उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड की अध्यक्षता केन्द्र सरकार द्वारा संहिता के अन्तर्गत बनाये गये नियमों में निर्दिष्ट व्यक्ति द्वारा की जायेगी। गणपूर्ति 27. उत्तराखण्ड भवन और अन्य संनिमार्ण कर्मचार कल्याण बोर्ड की किसी बैटक में तब तक कोई कारबार का संयवहार नहीं किया जायेगा जब तक उस बैटक में संहिता के अन्तर्गत केंद्र सरकार द्वारा बनाये नियम में निर्धारित गणपूर्ति पूर्ण न हो।

बैठक की सूचना एवं कार्य सूची

• 28. उत्तराखण्ड भवन और अन्य सिंमर्माण कर्मकार कल्याण बोर्ड की प्रत्येक साधारण बैठक का नोटिस, आकस्मिक बैठक को बुलाने का नोटिस एवं बोर्ड के बैठक के लिए कार्यालय की सूची की प्रक्रिया का निर्धारण इस संबंध में संहिता के अन्तर्गत केंद्र सरकार द्वारा बनाये नियम में निधारित प्रावधानों के अनुसार किया जायेगा। बैठक में किसी सदस्य के प्रतिभाग किये जाने की असमर्थता की स्थिति में
• 29. उत्तराखण्ड भवन और अन्य सिनिर्माण कर्मचार कल्याण बोर्ड के किसी सदस्य के किसी भी बैठक में भाग लेने में असमर्थता की स्थिति में अपना प्रतिनिधि नियुक्त किये जाने की प्रक्रिया का निर्धारण इस संबंध में संहिता के अन्तर्गत केंद्र सरकार द्वारा बनायी गये नियम में निर्धारित प्रावधान के अनुसार किया जायेगा। बोर्ड का कारबार
• 30. उत्तराखण्ड भवन और अन्य सिन्मार्ण कर्मकार कल्याण बोर्ड की बैठक की कार्यवाही की प्रक्रिया का निर्धारण संहिता के अन्तर्गत इस सम्बंध में केन्द्र सरकार द्वारा बनाये गये नियमों में निर्धारित प्रावधान के अनुसार किया जायेगा। बैठक का कार्यवृत्त
• 31. उत्तराखण्ड भवन और अन्य स्थितिमान कर्मचार कल्याण बोर्ड की प्रत्येक बैठक के कार्यवृत्त को अप्रेषित किये जाने, कार्यवृत्त की पुष्टि किये जाने व कार्यवृत्त को राज्य सरकार को प्रेषित किये जाने की प्रक्रिया का निर्धारण इस संबंध में संहिता के अन्तर्गत केंद्र सरकार द्वारा बनाये गये नियम में निर्धारित प्रावधान के अनुसार किया जायेगा। बोर्ड का सचिव
• 32. (1) उत्तराखण्ड भवन और अन्य सिनियर कर्मचार क्ल्याण बोर्ड का सचिव, बोर्ड का मुख्य कार्यपालक अधिकारी होगा।
• (2) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड का सचिव, अध्यक्ष की पूर्वनिमत्ति से बोर्ड की बैठक आहूत करने हेतु नोटिस भेजेगा तथा बोर्ड द्वारा कृत कार्यवाहियों का अभिलेखन करेगा, साथ ही बोर्ड द्वारा किये गये विनिश्चयों के कार्यान्वयन हेतु आवश्यक कदम उठायेगा। बोर्ड के सचिव व अन्य अधिकारियों व कर्मचारियों की नियुक्ति एवं सेवा शाटै
• 33. (1) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड राज्य सरकार की पूर्ण सहमति से किसी अधिकारी को जो राज्य सिविल सेवा अथवा श्रम विभाग के उप श्रमायुक्त की पंति से नीचे का न हो बोर्ड का सचिव नियुक्त करेगा ।

• (2) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड राज्य सरकार की पूर्ण सहमति से ऐसे अन्य अधिकारियों की नियुक्ति कर सकेगा;
• (i) जो श्रम विभाग में सहायक श्रमायुक्त की पंति से नीचे का न हो, तथा
• (ii) राज्य सरकार के किसी अन्य विभाग के ऐसे अन्य अधिकारियों की नियुक्ति कर सकेगा जैसा कि वह उसके कृत्यों के दक्षतापूर्ण निर्वाह के लिये आवश्यक समझे ।
• (3) उत्तराखण्ड भवन और अन्य सांनिमार्ण कर्मचार कल्याण बोर्ड के कर्मचारियों का दांचा व उनकी सेवा शांत राज्य सरकार द्वारा पृथक से निर्धारित की जायेगी। सचिव की प्रशासकीय एवं वित्तीय शक्तियां
• 34. (1) उत्तराखण्ड भवन और अन्य संनिमार्ग कर्मकार क्ल्याण बोर्ड का सचिव बोर्ड की सलाह के बिना ही आकस्मिक व्यय, संभरण एवं सेवाओं के निमित्त वस्तुओं का कय, निधि के प्रशासन हेतु कोष की प्रतिपूर्ति, ऐसी सीमाओं तक किसी वस्तु की खरीद के लिए व्यय की स्वीकृति प्रदान करने के लिए सक्षम होगा जिसकी सीमा बोर्ड द्वारा समय-समय पर निश्चित की जाये।
• (2) सचिव, उपनियम (1) में विनिर्दिष्ट विषयों को छोड़कर, ऐसे समस्त प्रशासकीय एवं वित्तीय शक्तियों का प्रयोग कर सकेगा जो उसको बोर्ड द्वारा समय-समय पर प्रतिनिधायित की जायें ।
• (3) उत्तराखण्ड भवन और अन्य :संज्ञान्मार्ग कर्मकार कल्याण बोर्ड विनिर्दिष्ट शाटों के अधीन, जैसा वह उचित समझे, समय-समय पर, कार्य के कुशल सम्पादन हेतु प्रशासनिक एवं वित्तीय शक्तियों का प्रतिनिधायन अपने अधीन कार्यरत किसी अन्य अधिकारी को कर सकेगा जिस सीमा तक वह ऐसा करना उचित समझे । अधिक्रमण एवं पुनर्गठन
• 35. (1) यदि उत्तराखण्ड भवन और अन्य सांनिमाण्य कर्मचार कल्याण बोर्ड अपने कूट्यों का पालन करने में असमर्थ है या अपने कूट्यों के निवर्धन में बार-बार विलंब करता है या अपनी शक्तियों अथवा अधिकारिता को पार करता है या उनका दुरुपयोग करता है, तो राज्य सरकार

अधिसूचना द्वारा उत्तराखण्ड भवन और अन्य सांनिर्माण कर्मचार कल्याण बोर्ड का अधिक्रमण कर सकेगी: पर्स्तु राज्य सरकार द्वारा अधिक्रमण की अधिसूचना जारी किये जाने से पूर्व उत्तराखण्ड भवन और अन्य सिन्माण कर्मचार कल्याण बोर्ड को युक्ति युक्त अवसर प्रदान किया जायेगा और उसके द्वारा दिए गए स्पष्टीकरणों और किए गए आक्षेपों पर विचार किये जाने के पश्चात् समुचित कार्यवाई की जायेगी

• (2) राज्य सरकार द्वारा संहिता की धारा 11 के अन्तर्गत केंद्रीय सरकार द्वारा निधारित रीति के अधीन उत्तराखण्ड भवन और अन्य संनिर्माण कर्मकार क्ल्याण बोर्ड का पुनर्गठन किया जायेगा।
• (3) उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार कल्याण बोर्ड के अधिक्रमण के पश्चात् एवं उसके पुनर्गठन किये जाने तक राज्य सरकार द्वारा संहिता के प्रासंगिक प्रावधानों के प्रशासन के उद्देश्य से केन्द्रीय सरकार द्वारा निर्धारित वैकल्पिक व्यवस्था की जायेगी।
• (4) उत्तराखण्ड भवन और अन्य संज्ञानम्न कर्मकार क्लयाण बोर्ड के अधिकरण की कार्यवाही और उसके अधिकरण के लिए होने वाली परिस्थितियों की पूरी रिपोर्ट राज्य विधान सभा के समक्ष अधिकरण की अधिसूचना की तारीख के तीन माह के अन्दर रखी जायेगी। निर्माण कामगारों के 36. लिए योजनाएं सहिता की धारा 7 की उपधारा (6) के खंड (ग), (घ) तथा (ङ) में उल्लिखित क्ल्याणकारी योजनाओं के संबंध में, उत्तराखण्ड भवन और अन्य संनिर्माण कर्मचार क्ल्याण बोर्ड द्वारा राज्य सरकार की पूर्ण स्वीकृति से भवन निर्माण श्रमिकों के लिए निम्नलिखित योजनाएं भी तैयार की जायेगी–
• (1) लाभार्थियों के लिए समूह बीमा योजना के प्रीमियम के संबंध में निर्धारित राशि का भुगतान के संबंध में,
• (2) लाभार्थियों के बच्चों के लाभ के लिए शैक्षिक योजनाएं बनाना, तथा
• (3) किसी लाभार्थी या उसके आभित की गंभीर बीमारियों के उपचार के लिए चिकित्सा व्ययों की पूर्ति करना।

अध्याय-3

कर्मचारी बीमा न्यायालय

कर्मचारी बीमा न्यायालय 37. में दूसरी अपील संहिता की धारा 37 की उपधारा (7) के खण्ड (ख) के अन्तर्गत बीमाकृत व्यक्ति या निगम, जैसा भी मामला हो, चिकित्सा बोर्ड या चिकित्सा अपील न्यायाधिकरण के निर्णय के सूचित होने की तिथि से नब्बे दिनों की अवधि के भीतर एक आवेदन प्रस्तुत करके कर्मचारी राज्य बीमा न्यायालय में अपील कर सकता है: परन्तु कर्मचारी बीमा न्यायालय नब्बे दिनों की अवधि के पश्चात् भी आवेदन पर विचार कर सकता है, यदि वह संतुष्ट है कि अपीलकर्ता के पास उक्त अवधि के भीतर आवेदन प्रस्तुत नहीं करने के पर्याप्त कारण थे । कर्मचारी बीमा न्यायालय 38. की संरचना, नियंत्रण एवं बैठक स्थल,

• (1) संहिता की धारा 48 के अन्तर्गत कर्मचारी बीमा न्यायालय सामान्यत: एक न्यायाधीश से गठित होगे: परंतु यह कि राज्य सरकार, कर्मचारी राज्य बीमा निगम से परामर्श के उपरांत, राजपत्र में अधिसूचना द्वारा किसी विशिष्ट कार्यवाही या कार्यवाहियों के वर्ग के लिए तथा अधिसूचना में निर्दिष्ट अवधि हेतु, किसी न्यायालय के लिए दो या अधिक न्यायाधीशों की नियुक्ति कर सकती है।
• (2) कर्मचारी बीमा न्यायालय, उत्तराखण्ड उच्च न्यायालय के प्रशासनिक नियंत्रण एवं पर्यवेक्षण के अधीन रहेगा तथा ऐसे रजिस्टर, लेखा-पुस्तकों, खातों एवं अभिलेख संधारित करेगा, जैसा कि उच्च न्यायालय समय-समय पर निर्धारित करे । कर्मचारी बीमा न्यायालय 39. की शक्तियां परंतु यह कि यदि न्यायालय इस बात से संतुष्ट हो कि आवेदक द्वारा निर्धारित अवधि के भीतर आवेदन कर्मचारी बीमा न्यायालय में आवेदन प्रस्तुत करने की रीति व प्रक्रिया
• 40. (1) संहिता की धारा 51 की उपधारा (1) के अंतर्गत कर्मचारी राज्य बीमा न्यायालय में आवेदन, प्रपत्र-क में तीन प्रतियों (Triplicate) में प्रस्तुत किया जाएगा तथा उसमें निम्नलिखित विवरण सम्मिलित होंगे—
• (क) उस न्यायालय का नाम जिसमें आवेदन प्रस्तुत किया गया है;
• (ख) आवेदक एवं प्रतिपक्षी का पूरा नाम, विवरण, आयु, व्यवसाय सहित तथा पूर्ण डाक पता;
• (ग) यदि आवेदक या प्रतिपक्षी नाबालिग हो अथवा विकृत चित्त (असंतुलित मानसिक अवस्था) का व्यक्ति हो, तो इस तथ्य का उल्लेख तथा उसके

• (ध) वह तथ्य जो वाद—कारण (Cause of Action) का निर्माण करते हों तथा वह तिथि जब वाद—कारण उत्पन्न हुआ;
• (डं) वे तथ्य जिनसे यह प्रदर्शित होता हो कि न्यायालय को अधिकारिता प्राप्त है;
• (च) वह अनुतोष (Relief) जिसकी मांग आवेदक द्वारा की गई है।
• (2) प्रत्येक आवेदन का सत्यापन उसी प्रकार किया जाएगा, जैसा कि दीवानी न्यायालय में वादपत्र (Pleading) के लिए किया जाता है।
• (3) जिन सभी दस्तावेजों पर आवेदन आधारित है, उन्हें एक शुद्ध एवं स्टैटिक सूची सहित आवेदन के साथ संलग्न किया जाएगा।
• (4) सभी आवेदनों को न्यायालय द्वारा प्रपत्र-ख संनिधारित रीति से संधारित किए जाने वाले रजिस्टर में प्रविष्ट किया जाएगा।

41. कर्मचारी राज्य बीमा न्यायालय के समक्ष आवेदन प्रस्तुत किये जाने का शुल्क

• (1) कर्मचारी राज्य बीमा न्यायालय के समक्ष सिंहिता में निर्दिष्ट किसी भी विषय के संबंध में प्रस्तुत आवेदन पर देय शुल्क ₹100/- होगा।
• (2) अन्य विषयों के संग्ध में देय शुल्क एवं व्यय, जैसा अधीनस्थ न्यायालयों के लिए उच्च न्यायालय द्वारा निर्धारित किया गया है, के अनुसार होगा।
• (3) इस नियम के अंतर्गत देय समस्त शुल्क एवं व्यय न्यायालय शुल्क टिकट (Court Fee Stamps) के माध्यम से वसूल किए जाएंगे।

अध्याय-4

उपादान

अवयस्कों के लाभ के लिए उपादान

• 42. यदि कोई नामित व्यक्ति या उत्तराधिकारी नाबालिग है, तो धारा 53 की उपधारा (1) के तीसरे परंतुक में निर्दिष्ट सहाम अधिकारी उस नाबालिक के हित लाभ के लिए नियोक्ता द्वारा उसके पास जमा की गई उपादान राशि को भारतीय स्टेट बैंक या किसी भी राष्ट्रीकृत बैंक में सावधि जमा में निवेश करेगा। नामांकन का समय, प्रारूप व रीति, नया नामांकन, नामांकन में संशोधन
• 43. (1) सिहता की धारा 55 के अन्तर्गत प्रत्येक कर्मचारी जिसने इस नियमावली के प्रारंभ होने से पूर्व एक वर्ष तक कार्य कर लिया है और नामांकन नहीं किया है तो वह इस नियमावली के लागू होने की तिथि से छः माह के भीतर प्रपत्र-। (दो प्रतियों) में नामांकन कर सकेगा जो इलेक्ट्रॉनिक रूप से या पंजीकृत डाक पावती द्वारा प्रस्तुत किया जायेगा। यदि कर्मचारी नियमावली लागू होने के पश्चात् नियुक्त होता है तो वह एक वर्ष पूरा करने के छः माह के भीतर प्रपत्र-। (दो प्रतियों) में नामांकन इलेक्ट्रॉनिक रूप से या पंजीकृत डाक पावती द्वारा प्रस्तुत करेगा। परन्तुक सेवायोजक इस आधार पर कि नामांकन निर्धारित अवधि के पश्चात् दाखिल किया गया है, उसे अमान्य नहीं किया जायेगा ।
• (2) उप-नियम (1) के अन्तर्गत प्रप्त—। में नामांकन की प्राप्ति के तीस दिनों के भीतर, नियोक्ता कर्मचारी की सेवा विवरण प्राप्त करेगा, जैसा कि नामांकन प्रप्त में उल्लेख किया गया है, एवं प्रतिष्ठान के सिकॉर्ड से सत्यापित किया जाएगा एवं रसीद प्राप्त करने के पश्चात् कर्मचारी को वापस कर दिया जाएगा। इस अलावा प्रप्त —। में नामांकन की द्वितीय कॉपी, जो नियोक्ता या उसके द्वारा इस संबंध में अधिकृत अधिकारी द्वारा विधिवत् सत्यापित हो, नियोक्ता द्वारा नामांकन के सिकॉर्डिंग के प्रमाण के रूप में रख ली जाएगी।

• (3) नामांकन करते समय यदि किसी कर्मचारी का कोई खुद्दुं नहीं है, तो उसे खुद्दुं प्राप्त करने के नब दिनों के भीतर उपनियम (1) में निर्दिष्ट तरीके से भारा 55 की उपधारा (4) के अधीन आवश्यक रूप में नियोक्ता को प्रप्त्र-। की दो प्रतियों में नया नामांकन प्रस्तुत करना होगा और इसके पश्चात उपनियम (2) के उपबंध यथोचित परिवर्तन सहित लागू होंगें, जैसे यह उप नियम (1) के अधीन बनाए गए थे।
• (4) नामांकन में संशोधन की सूचना, जिसमें ऐसे मामले भी शामिल है, जहां नामित व्यक्ति की कर्मचारी से पूर्व मुट्यू हो जाती है, उपनियम (1) में निर्दिष्ट रीति से नियोक्ता को प्रपत्र-1 की दो प्रतियों में प्रस्तुत की जाएगी और इसके बाद उपनियम (2) के उपबंध यथोचित परिवर्तन सहित लागू होंगे, जैसे यह उपनियम (1) के अधीन बनाए गए थे।
• (6) नामांकन, नया नामांकन या नामांकन में संशोधन की सूचना नियोक्ता द्वारा इसकी प्राप्ति की तिथि से प्रभावी होगी। उपादान के लिए 44. लिखित आवेदन धारा 56 की उपधारा (1) के अन्तर्गत एक कर्मचारी जो संहिता के अधीन ग्रेच्युटी के भुगतान के लिए पात्र है, या कोई भी व्यक्ति, जो लिखित रूप में कर्मचारी द्वारा अधिकृत है, अपनी ओर से कार्यावाई करने के लिए, आमतौर पर, ग्रेच्युटी देय होने की तारीख से तीस दिनों के भीतर नियोक्ता को प्रप्त-II में

आवेदन करेगा, परन्तु यदि किसी कारणवश जो युक्तिसंगत हो तीस दिन के पश्चात भी आवेदन कर सकता है: परन्तु यह कि कोई कर्मचारी सेवानिवृत्ति की तारीख के तीस दिनों से पहले भी नियोक्ता को आवेदन कर सकता है। सक्षम प्राधिकारी का 45. आवेदन धारा 56 की उपधारा (5) के खण्ड (ख) के अन्तर्गत यदि ग्रेस्टूटी की धनराशि/दावे की स्वीकार्यता या अहंता को लेकर कोई विवाद है, वहा नियोजक या कर्मचारी या अधिकृत व्यक्ति सक्षम प्राधिकारी को विवाद का निर्णय करने के लिए निर्धारित प्रपत्र -III में आवेदन कर सकेगा। आवेदन के साथ साक्ष्य के रूप में वह सभी अभिलेख दाखिल करने होगे जो आवेदक आवश्यक समझे। सक्षम अधिकारी प्राप्त आवेदन की जांच हेतु पक्षकारों को समन करेगा और पर्याप्त सुनवाई का अवसर प्रदान करेगा और दस्तावेज और साक्ष्य प्रस्तुत करने का अवसर प्रदान करेगा। सक्षम प्राधिकारी के रूप 46. रूप में नियुक्त अधिकारी की अहंता एवं अनुभव धारा 58 की उपधारा (1) के अन्तर्गत साक्षम अधिकारी की नियुक्ति अधिसूचना द्वारा राज्य सरकार द्वारा श्रम मामलों का अनुभव रखने वाले अपने राजपत्रित अधिकारियों में से की जायेगी।

अध्याय-5

प्रसूति प्रसुविधा

47. निरीक्षक-सह-सुकारक के आदेश के विरुद्ध अपीलीय प्राधिकारी

नियोक्ता द्वारा सहमत प्राधिकारी के पास कर्मचारी के अंतिम संस्कार के व्यय के लिए जमा की जाने वाली राशि 48. यदि कर्मचारी को हुई क्षति के परिणामस्वरूप उसकी मृत्यु हो जाती है, तो नियोक्ता संहिता की धारा 76 की उपधारा (1) के अधीन मुआवजे के अतिरिक्त सक्षम प्राधिकारी के पास कम से कम 15,000/- रुपये या राज्य सरकार द्वारा अधिसूचित ऐसी राशि जमा की जायेगी, जिसका भुगतान कर्मचारी के अतिम संस्कार के व्यय के लिए कर्मचारी के सबसे बड़े उत्तरजीवी आश्रित को अथवा जहां कर्मचारी का कोई आश्रित नहीं है अथवा वह अपनी मृत्यु के समय अपने आश्रितों के साथ नहीं रह रहा था, वहां उस व्यक्ति को किया जाएगा, जिसने वास्तव में ऐसा व्यय उपगत किया है: परन्तु यदि केन्द्र सरकार धारा 76 की उप धारा (7) में निर्दिष्ट धनराशि में वृद्धि करती है तो राज्य सरकार द्वारा उसका पालन किया जायेगा। चिकित्सा व्यवसायी के प्रसाण पत्र के बिना पुनर्विलोकन के लिए शार्ट 49. धारा 79 की उपधारा (1) के अधीन पक्षकारों के बीच हुए किसी कारार या सक्षम प्राधिकारी के आदेश के अधीन ऐसे अर्थमासिक संदाय का पुनर्विलोकन जो इस संहिता के अधीन संदेय है, सक्षम प्राधिकारी द्वारा या तो नियोजक के या कर्मचारी के आवेदन पर जिसके साथ चिकित्सक (जो उत्तराखण्ड मेडिकल काउंसिल में पंजीकृत हो) का यह प्रमाण पत्र होगा कि कर्मचारी की दशा में परिवर्तन हो गया है तो उसके लिए आवेदन कर सकेगा। 50, धारा 82 की उपधारा (4) के अधीन नियोजक अपने परिसर में जिसमें कर्मचारी नियोजित है, प्रपत्र- IV में निर्धारित प्रारूप के अनुसार सूचना पुस्तिका रखेंगें जिस पर परिसर में काम करने वाले अधिकारी/कर्मचारी की पहुंच युक्त-युक्त समय पर आसानी से हो सकेगी।

परन्तु

• (III) सक्षम प्राधिकारी किसी भी समय रजिस्टर को परिशुद्ध कर सकेगा;
• (III) जहां कि सक्षम प्राधिकारी को यह प्रतीत होता है की एकमुश्त राशि के संदय के बारे में कोई करार वह चाहे अर्थमासिक संदय से विमोचन के तौर पर हो या अन्य हो, किसी स्त्री या विधिक नियोंग्यता के अधीन किसी व्यक्ति को संदेय प्रतिकार की रकम के बारे में कोई करार राशि या रकम की अप्रार्याप्ता के कारण या असम्यक असर या अनुचित साधनों द्वारा उस करार के अभिप्राप्त किये जाने के कारण रजिस्ट्रीकृत नहीं किया जाना चाहिए, वहाँ वह करार के ज्ञापन को अभिलिखित करने से इंकार कर सकेगा और ऐसा आदेश जिसके अन्तर्गत करार के अधीन पहले दी गई किसी राशि के बारे में कोई आदेश आता है कर सकेगा जैसा वह उन परिस्थितियों में न्याय संगत समझे।

54. सक्षम प्राधिकारी की नियुक्ति हेतु अनुभव एवं योग्यताएं सहिता की धरा 91 की उपधारा (1) के अधीन राज्य सरकार किसी ऐसे व्यक्ति को जो सहायक अध्यायुक्त के पद से न्यून न हो तथा 05 वर्ष का अनुभव रखता हो, अधिसूचना द्वारा सक्षम प्राधिकारी नियुक्त कर सकेगी अथवा उप अध्यायुक्त को इस हेतु सक्षम प्राधिकारी के रूप में अधिसूचना में विनिर्दिष्ट किया जायेगा। परन्तु यह की ऐसे किसी व्यक्ति जो पाँच वर्ष तक सुलह अधिकारी के रूप में कार्य कर चुका हो उसे सक्षम

प्राधिकारी के रूप में नियुक्त किये जाने के लिए उपरोक्त उल्लिखित अनुभव की आवश्यकता नहीं है। सक्षम प्राधिकारी द्वारा 55. या उसके समक्ष किसी विषय पर कार्यवाही किये जाने की रीति

• (1) संहिता धारा 92 की उपधारा (1) के अन्तर्गत इस अध्याय के अधीन कोई बात सक्षम प्राधिकारी द्वारा या उसके समक्ष की जानी है वहां इस अध्याय के उपबन्धों के अधीन रहते हुए उस क्षेत्र के लिए प्राधिकारी द्वारा की जायेगी, जिसमें:-
• (क) वह दुर्घटना हुई थी जिसके परिणाम स्वरूप क्षति हुई थी या;
• (ख) कर्मचारी या उसकी मृत्यु की दशा में प्रतिकर के लिए दावा करने वाला आभित साधारणतया निवास करता है या;
• (ग) नियोजक का रजिस्ट्रीकृत कार्यालय है; परन्तु यह कि किसी भी मामले में ऐसे किसी साम्य प्राधिकारी के समक्ष या उसके द्वारा जो उस क्षेत्र पर जिसमें दुर्घटना हुई है, अधिकारिता रखने वाले साम्य प्राधिकारी से मिन्न है वह उस क्षेत्र पर आधिकारिता रखने वाले साम्य प्राधिकारी और राज्य सरकार को इलैक्ट्रॉनिक रूप से या रिजिस्ट्रीकृत डाक से सूचना दिये बिना कार्यवाही नही करेगा: परन्तु यह और कि जहाँ कर्मचारी किसी पोट का मास्टर या नाविक है अथवा किसी वायुयान का कोप्टन या कर्मदल का कोई सदस्य है अथवा किसी मोटरयान या कम्पनी का कर्मचारी है, भारत से बाहर दुर्घटना का शिकार होता है वहा ऐसी कोई बात उस क्षेत्र के सक्षम प्राधिकारी या उसके समक्ष कि जा सकेगी जिसमें यथा स्थिति पोट, वायुयान या मोटरयान का स्वामी या अभिकर्ता निवास करता है या कारोबार चलाता है अथवा कम्पनी का रिजिस्ट्रीकृत कार्यालय स्थित है।

• (2) यदि आवेदन प्राप्त होने पर सक्षम प्राधिकारी को यह प्रतीत होता है की उक्त आवेदन अन्य सक्षम प्राधिकारी को प्रस्तुत किया जाना चाहिए था तो वह आवेदक को प्रस्तुतिकरण तथा वापसी का दिनांक कारण सहित लिखते हुए, उस सक्षम प्राधिकारी का पदनाम जिसे प्रस्तुत किया जाना चाहिए का उल्लेख करते हुए वापिस कर देना चाहिए।
• (3) ऐसा साधम प्राधिकारी जिससे उक्त प्रकरण हस्तान्तरित किया गया हो कार्यवाही जारी रखेगा जैसे पूर्व की सभी कार्यवाहियाँ उसके समक्ष की गई हो यदि वह इस तथ्य से संतुष्ट हो कि इससे पक्षकारों के हितों पर प्रतिकूल प्रभाव नहीं पड़ेगा।
• (4) साक्षम प्राधिकारी आवेदन पर विचार करने के पश्चात् आवेदन को स्कैम्पेट: खारिज कर सकता है यदि अभिलिखित किये जाने वाले कारणों से उसकी यह राय हो जाती है की उस पर कार्यवाही करने के पर्याप्त आधार नहीं हैं।
• (5) यदि आवेदन प्राधिकारी द्वारा खारिज नहीं किया जाता है तो वह प्रतिवादी/प्रतिवादियों को संलग्न आवेदन और अन्य अभिलेखों की प्रति के साथ समन जारी करेगा।
• (6) यदि प्रतिवादी दावे का प्रतिवाद करना चाहता है तो वह अभिलेखों के साथ लिखित कथन दाखिल करेगा और यदि नहीं करता है तो सक्षम प्राधिकारी आवेदन का परीक्षण करेगा और उसके परिणाम को लिपिबद्ध करेगा।
• (7) यदि प्रतिवादी लिखित कथन दाखिल करता है तो वादी अपना प्रत्युत्तर दाखिल कर सकता है।
• (8) सक्षम प्राधिकारी पक्षकारों से अपना-अपना साक्ष्य शापथ पत्र पर दाखिल करने के लिए प्रस्तुत कर सकते हैं जिस पर विरोधी पक्षकार को प्रति परीक्षा कराने का अधिकार होगा।

56. दुर्घटना के लिए आवेदन के निपटान की समय सीमा और कार्यवाही के लिए अनुषांगिक खर्चे

• (2) ऐसे प्रत्येक आवेदन के अनुपांगिक खर्चे कुल धनराशि (जिसका आवेदक द्वारा दावा किया गया है) का एक प्रतिशत वाद व्यय होगा, परन्तु यदि किसी मामले में आवेदक किसी कारणवश फीस का अग्रिम संदाय करने में असमर्थ हो तो सक्षम प्राधिकारी फीस का संदाय मामले के अंतिम निस्तारण के पश्चात् लेने का निश्चय कर सकता है। परन्तु यह कि किसी चिकित्सीय साक्षी का साक्ष्य यथाशक्य शब्दश: लिखा जायेगा ।

अध्याय-7

भवन और अन्य निर्माण कर्मकारों के संबंध में समाजिक सुरक्षा और उपकर

नियोजक द्वारा संहिता की धारा 100 के अधीन उपकर की किसी रकम को तीस दिन के भीतर सक्षम प्राधिकारी के समक्ष जमा किया जायेगा। यदि नियोजक तीस दिनों में संदाय करने में विफल रहता है तो ऐसा नियोजक संदाय की जाने वाली उपकर की रकम पर ऐसी अवधि के लिए उस तारीख से जिससे ऐसा संदाय शोध्य है उस रकम के वास्तविक रूप से संगत किये जाने तक ऐसी दर पर जो केंद्रीय सरकार द्वारा विहित की गयी है, ब्याज संदत्त करने के लिए उत्तरदायी होगा। अपील हेतु शुल्क

• 59. (1) कोई नियोजक जो धारा 103 के अधीन किये गये निर्धारण के आदेश या धारा 104 के अधीन किये गये शासित अधिरोपित करने के आदेश से व्यथित है, तो वह संहिता की धारा 105 के अधीन ऐसे समय के भीतर जो केन्द्र सरकार द्वारा विहित किया जाय, अपील कर सकेगा। धारा 105 की उप धारा (2) के अधीन प्रत्येक अपील के साथ 20 लाख रुपये तक के उपकर पर 10 हजार रुपया तथा 20 लाख रुपया से ऊपर के उपकर पर 20 हजार रुपया की पीस दाखिल करनी होगी।
• (2) अपील शुल्क अपील खारिज होने की स्थिति में जब्ती योग्य होगा।

अध्याय-8

वित्त और लेखा चल या अचल निवेश 60. को अर्जित/धारण/ हस्तांतरित/ऋण जुटाने तथा भविष्य निधि गठित करने आदि की शर्तें धारा 120 की उप धारा (2) के अन्तर्गत किसी चल या अचल निवेश को अर्जित करने, धारण करने, बेचने या अन्यथा हस्तांतरित करने की शर्त, उपधारा (3) के अन्तर्गत ऋण जुटाने और ऐसे ऋणों के भुगतान के लिए उपाय करने की शर्त और उपधारा (4) के अंतर्गत अधिकारियों और कर्मचारियों या उनके किसी वर्ग के लाभ के लिए भविष्य निधि या अन्य

लाभ निधि गठित करने की शर्त ऐसी होंगी, जैसा राज्य सरकार वित्त विभाग के परामर्श से अधिसूचित करे। अप्रतिसंहरणीय शोध्य को बट्टे खाते में डालने की शर्तें

• 61. जहाँ असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड की राय है कि असंगठित कर्मकार सामाजिक सुरक्षा बोर्ड को देय अंशदान, उपकर, ब्याज और हर्जाने की राशि वसूली न किए जा सकने वाली हो गई है, बोर्ड या उसके द्वारा इस संबंध में अधिकृत कोई अन्य अधिकारी निर्मित शाटों के अधीन उक्त राशि को बड़े खाते में डालने की मंजूरी दे सकता है, अर्थात:-
• (i) कि संबंधित प्रतिष्ठान पांच वर्ष से अधिक समय से बंद है और ऐसे प्रतिष्ठान के नियोक्ता का टिकाना सभी सम्भव प्रयासों के बावजूद पता नहीं लगाया जा सकता है।
• (ii) कि सामाजिक सुरक्षा बोर्ड द्वारा प्राप्त डिक्री को चूककर्ता नियोक्ता की पर्याप्त परिसंपत्तियों के अभाव में सफलता पूर्वक निष्पादित नहीं किया जा सका: या
• (iii) कि अंशदान के लिए दावा निम्नलिखित द्वारा पूरी तरह से पूरा नहीं किया गया हैं–
• (क) कारखानों/प्रतिष्ठानों के परिसमापन की स्थिति में आधिकारिक परिसमापक: या
• (ख) इकाई के राष्ट्रीयकरण या सरकार द्वारा अधिग्रहण की स्थिति में।

अध्याय—9

प्राधिकारी, निधारण अनुपालन और वसूली

निरीक्षक-सह-सुविधा प्रदाता की अन्य शक्तियां

• 62. निरीक्षक-सह-सुविधा प्रदाता संहिता की धारा 122 की उप धारा (6) के अधीन प्रदत्त शक्तियों के अतिरिक्त ऐसी अन्य शक्तियों का प्रयोग करेगा और ऐसे अन्य कर्त्त्वों का पालन करेगा, जिसे राज्य सरकार सामान्य या विशेष आदेश से लागू करें।

अभिलेखों और रजिस्टरों आदि के रख-रखाव के लिए प्रपत्र और रीति

• 63. (क) प्रत्येक नियोक्ता द्वारा कर्मचारियों का रजिस्टर, हाजरी एवं मस्टर रोल का रजिस्टर, मजदूरी कटौती जुमाने एवं उनकी वसूली का विवरण, महिला कर्मचारियों का रजिस्टर उत्तराखण्ड मजदूरी संहिता नियमावली, 2026 के अन्तर्गत निर्धारित प्रप्त्र में रखा जायेगा।
• (ख) इस अध्याय के अधीन सभी रजिस्टरों का इलेक्ट्रॉनिक रूप से या मैनुवल रूप से रख–रखाव किया जाएगा जिनमें सभी प्रविष्टियाँ हिन्दी अथवा अंग्रेजी भाषा में की जाएगी।
• (ग) प्रत्येक नियोक्ता, निरीक्षक सह सुविधा प्रदाता या किसी प्राधिकारी द्वारा मागें जाने पर रिकार्ड तथा रजिस्टर को प्रस्तुत करेगा।
• (घ) भवन और अन्य सन्निर्माण कार्य के सम्बन्ध में दिये गये उपकर के अमिलेख भी सुरक्षित रखेंगा जिससे प्राधिकारी द्वारा मांग जाने पर उपलब्ध कराएगा।
• (ड) सभी रजिस्टर तथा अन्य रिकार्ड को अंतिम प्रविष्टि की तिथि से पाँच कैलेंडर वर्ष की अवधि के लिए मूल रूप से सुरक्षित रखा जाएगा।
• (च) प्रत्येक नियोक्ता मजदूरी के भुगतान से 24 (चौबीस) घंट पूर्ण संहिता की धारा 123 के खंड (ग) के अधीन कर्मचारियों को इलैक्ट्रॉनिक या मैनुवल रूप से उत्तराखण्ड मजदूरी संहिता नियमावली 2026, में निर्धारित प्रपत्र में वेतन पर्ची उपलब्ध कराएगा।
• (ख) उक्त प्रतिष्ठान के संबंध में जिसमें मजदूरी संहिता, 2019 के अधीन बनाये गये नियमों अथवा उपाजीविकाजन्य सुरक्षा, स्वास्थ्य और कार्यदशा संहिता, 2020 के अधीन रजिस्टर का रख-रखाव अपेक्षित हो उन संहिताओं और उनके अधीन बनाये गये नियमों के अधीन नियोक्ता द्वारा कर्मचारियों का रजिस्टर, हाजरी एवं मस्तर रोल का रजिस्टर, मजदूरी, समयोपरि तथा कटौती का रजिस्टर तथा मजदूरी पर्ची अनुरक्षित की जाएगी।

• (ख) नियोक्ता प्रति वर्ष 31 मार्च से पूर्व पूर्ववर्ती वर्ष के संबंध में विनिर्दिष्ट ब्योरों के बारे में सूचना देते हुए श्रम विभाग की वेबसाईट पर ऑनलाइन निर्धारित प्रारूप में एकिकृत वार्षिक विवरणी अपलोड करेगा तथा प्राधिकारी के मार्ग जाने पर उसे उपलब्ध कराएगा।

अध्याय-10

अपराध एवं शास्तियां

सहिता की धारा 138 की उपधारा (1) के तहत अपराधों के शमन के प्रयोजन के लिए राज्य सरकार द्वारा प्राधिकृत अधिकारी को धारा 138 के अधीन शामनीय अपराधों के लिए वह व्यक्ति जिसे नोटिस दिया गया है, प्रपत्र–VIII में इलेक्ट्रॉनिक रूप में आवेदन करेगा तथा नोटिस प्राप्त होने की तारीख से 15 दिनों के भीतर इलेक्ट्रॉनिक या हस्ताक्षर रूप में शामनीय राशि को जमा करवाएगा।

अध्याय-11

सामाजिक सुरक्षा निधि 65. के छोट संहिता की धारा 141 की उपधारा (5) के अन्तर्गत असंगठित कर्मकार के कल्याण के लिए राज्य सरकार द्वारा स्थापित सामाजिक सुरक्षा निधिं में निम्न स्रोत से प्राप्त राशि जना की जायेगी–

• I. इस संहिता के अधीन अपराधों के शमन से प्राप्त धनराशि।
• II. राज्य सरकार द्वारा निधि की स्थापना हेतु दी गई धनराशि।

• VIII. ऐसे अन्य स्रोत जो राज्य सरकार समय समय पर निर्धारित करें। सामाजिक सुरक्षा निधि 66. का प्रशासन व व्यय
• (1) सामाजिक सुरक्षा निधि के अन्तर्गत प्राप्त सम्पूर्ण निधि को किसी राष्ट्रीयकृत बैंक के खाते में रखा जायेगा।
• (2) निधि का उपयोग उत्तराखण्ड असंगठित कर्मचारी सामाजिक सुरक्षा बोर्ड द्वारा लाभार्थी के रूप में पंजीकृत असंगठित कर्मचारियों एवं उनके परिवार के कल्याण के लिए राज्य सरकार की पूर्व स्वीकृत से तैयार की गयी एवं अधिसूचित योजना पर किया जायेगा।
• (3) निधि के लेखाओं की लेखा परीक्षा राज्य सरकार द्वारा समय-समय पर जारी अनुदेशों के अनुसार की जायेगी।

The Uttarakhand Social Security Code Rules, 2026.

Chapter- 1

Preliminary

Short title, extent 1. and commencement

• (1) These rules may be called the Uttarakhand Social Security Code Rules, 2026.
• (2) They shall extend to the whole of the State of Uttarakhand.
• (3) They shall come into force after the date of their final publication in the Official Gazette. Definitions
• 2. (1) In these rules, unless the context otherwise requires,—
• (a) “Authority” means the authority specified by the State Government
• (b) “Assessing Officer” means any Gazetted Officer of the State Government or any officer of a local authority who is equivalent to a Gazetted Officer of the State Government and who has been appointed by such State Government for assessment of cess under the Code.
• (c) “Company” means a company as defined under section 2 of the Companies Act, 2013.
• (d) “Competent Authority” means, as the case may be, any officer appointed by the State Government as the competent authority under section 58 or section 91 of the Social Security Code, 2020.
• (f) “Cess Collector” means an officer appointed by the State Government for collection of cess under the Code.
• (g) “Chairperson” means the Chairperson of the Uttarakhand Uttarakhand Unorganized Workers Social Security Board and Uttarakhand Building and Other Construction Workers Welfare Board
• (h) “Code” means the Social Security Code, 2020 (Act No. 36 of 2020).
• (i) “Electronically” means, for the purposes of the Code, submission through e-mail in any mode, or uploading on the specified portal, or making digital payment through any mode.
• (k) “Government securities” means government securities as defined in the Government Securities Act, 2006.
• (1) “Nomination” means a nomination made under section 55 of the Code.
• (m) “Schedule” means the Schedule to the Code.
• (n) “Section” means a section of the Code.
• (o) “Portal” means the official web portal of the Labour Department, Uttarakhand, or any web portal operated by the State Government for this purpose.

• (p) “Specified” means specified by the State Government or by any officer authorised by the State Government by order.
• (r) “Year” means the financial year commencing on the first day of April and ending on the thirty-first day of March of the following year.
• (2) Words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Social Security Code, 2020.

(A) Uttarakhand Unorganized Workers Social Security Board

• (1) The Uttarakhand Unorganized Workers Social Security Board shall be constituted by the State Government for a term of three years with the members specified in sub-section (10) of section 6 of the Code.

• (2) The State Government shall seek nomination from amongst the representatives of associations of unorganised sector workers and employers’ associations of unorganised sector, in the category of sub-clauses (i) and (ii) of clause (d) of sub-section (10) of section 6: Provided that out of seven persons nominated under said sub-clause (i), one member each from the Scheduled Caste, the Scheduled Tribe, the minorities and women shall be represented.
• (3) The State Government shall seek nomination for members from the Speaker of the Uttarakhand Legislative Assembly under clause (iii) of sub-section (d) of sub-section (10) of section 6 of the Code.
• (4) The State Government shall nominate five persons under sub-clause (iv) of clause (d) of sub-section (10) of section 6 from amongst persons of eminence in the field of labour welfare, management, finance, law and administration.
• (5) The State Government shall nominate ten members under sub-clause (v) of clause (d) of sub-section (10) of section 6 representing Departments of the State Government, concerned with the matters related to the welfare of the unorganised sector workers.
• (6) (a) The State Government shall initiate the process for reconstitution of the Uttarakhand Unorganized Workers Social Security Board, prior to six months of expiry of the term of the Board.
• (b) If the new Board is not re-constituted after completion of the term of the Uttarakhand Unorganized Workers Social Security Board, such arrangements may be made for discharging the functions of the Board

as may be decided by the state Government for the period till the new Board is constituted, through a notification.

• (c) Consequent upon institution of arrangement referred to in clause (b), all actions taken shall have the same effect as if it has been carried out by the Board itself. Term of office of 4. member
• (1) A member of the Uttarakhand Unorganized Workers Social Security Board other than an ex officio member thereof, shall hold office for a period not exceeding three years from the date of his nomination: Provided that a member, other than an ex officio member, shall not hold the office for more than total of two terms.
• (2) A member nominated under sub-clause (iii) of clause (d) of sub-section (10) of section 6 shall cease to be a member of the Uttarakhand Unorganized Workers Social Security Board, if he ceases to be a member of the Uttarakhand legislative Assembly.
• (3) A member nominated under sub-clauses (i), (ii) and (iv) of clause (d) of sub-section (10) of section 6, shall cease to be a member of the Uttarakhand Unorganized Workers Social Security Board, if he ceases to represent the category of interest from which he was so nominated. Resignation
• 5. (1) A member of the Uttarakhand Unorganized Workers Social Security Board, not being an ex officio member, may resign by a letter in writing addressed to the State Government.
• (2) The seat of such a member shall fall vacant from the date on which his resignation is accepted or on the expiry of thirty days from the date of

receipt of intimation of resignation, whichever is earlier.

• (3) The power to accept the resignation of such member shall vest with the State Government. After the resignation is accepted, it will be presented by the Member-Secretary to the Uttarakhand Unorganized Workers Social Security Board in its next meeting. Change Address
• 6. If a member changes his address, he shall notify his new address to the Member-Secretary of the Uttarakhand Unorganized Workers Social Security Board, who shall thereupon enter his new address in the official records: Provided that if a member fails to notify his new address, the address in the official records shall for all purposes be deemed to be the member's correct address.
• 7. (1) No person shall be chosen as a member of the Uttarakhand Unorganized Workers Social Security Board or Nor shall he continue to be a member of the Uttarakhand Unorganized Workers Social Security Board, if such person falls under any provision of section 8. Manner of filling vacancies the person so nominated shall hold office for the remainder of the term of office of the member in whose place he is nominated.

Allowances of

members

• 9. (1) The travelling allowance of an official member of the Uttarakhand Unorganized Workers Social Security Board shall be governed by the rules applicable to him for journey performed by him on official duties and shall be paid by the authority paying his salary.

Function of board

• 10. The Uttarakhand Unorganized Workers Social Security Board shall perform the functions mentioned in sub-section 15 of Section 9 of the Code.

Disposal of business

• 11. Every matter which the Uttarakhand Unorganized Workers Social Security Board is required to take into consideration shall be considered at a meeting of the Board, or if the Chairperson so directs, by sending the necessary papers to every member for opinion, and the matter shall be disposed of in accordance with the decision of the majority: Provided that where there is no opinion of majority on a matter and the members of the Board are equally divided, the Chairperson shall have a second or a casting vote.

Meeting

• 12. (1) the Uttarakhand Unorganized Workers Social Security Board shall meet at such places and at such times as may be decided by the Chairperson.

• (2) Uttarakhand Unorganized Workers Social Security Board shall meet at least once in three months.
• (3) The Chairperson of the Uttarakhnd Unorganized Workers Social Security Board whenever he thinks fit, and shall within fifteen days of the receipt of a requisition in writing from not less than one half of the members of the board call for a special meeting thereof and a requisition so made shall specify the object of the meeting proposed to be called. Chairing the meeting
• 13. (1) The meeting of the Board shall be presided over by the Chairman of Uttarakhand Unorganized Workers Social Security Board.
• (2) The absence of the Chairman, the Vice-Chairman, shall preside over the meeting. In the absence of the Chairman and the Vice-Chairman, the meeting shall be presided over by a member nominated by the Chairman. Notice of meeting and agenda
• 14. (1) A notice of not less than fifteen days from the date of issue, containing the date, time and place of every ordinary meeting of the Uttarakhand Unorganized Workers Social Security Board together with a list of business proposed to be transacted and approved by the Chairperson concerned shall be sent to every member of Board through e-mail or registered post or by special messenger, and a brief note on each item of the agenda shall be sent along with the agenda as soon thereafter as possible.
• (2) The Chairperson calls an emergency meeting of the Uttarakhand Unorganized Workers Social Security Board for considering any matter which in his opinion is urgent, a notice giving such reasonable time as he may consider necessary shall be deemed sufficient and shall be sent to every member of Board through e-mail or registered post or by special messenger.

• (3) No business other than for which the meeting of the Uttarakhand Unorganized Workers Social Security Board has been convened shall be considered at the meeting except with the permission of the Chairperson of the meeting. Quorum
• 15. No business shall be transacted in any meeting of the Uttarakhand Unorganized Workers Social Security Board unless at least one fourth members are present in that meeting: Provided that if the number of members present at a meeting is less than the prescribed quorum, the meeting shall be adjourned by the Chairman for one hour and thereafter the business at such adjourned meeting shall be valid for transaction irrespective of the number of members present. Supersession Reorganization
• and 16. (1) Uttarakhand Unorganized Workers Social Security Board is unable to perform its functions, or, has persistently made delay in the discharge of its functions or has exceeded or abused its powers or jurisdiction, then State Government may, by notification, supersede the Uttarakhand Unorganized Workers Social Security Board.
• (3) The Uttarakhand Unorganized Workers Social Security Board shall be reconstituted by the State Government in the manner prescribed by the
• (b) One member nominated by the Central Government.
• (d) Three members appointed by the State Government representing the employers.
• (e) Three members nominated by the State Government representing the building and other construction workers.
• (2) Among the appointed members at least, one member shall be a woman. Term of Office
• 19. (1) Any member of the Uttarakhand Building and Other Construction Workers Welfare Board, who is not an ex-officio member, may resign his office by a self-handwritten letter through electronic mail or registered post addressed to the State Government.
• (2) The seat of such a member shall be deemed vacant from the date of acceptance of his resignation or after the expiry of thirty days from the receipt of the notice of resignation, whichever is earlier. Change of Address

Disqualification and 21. Removal of Member

• (1) No person shall be chosen as a member of the Uttarakhand Building and Other Construction Workers Welfare Board, nor shall he remain a member of the Uttarakhand Building and Other Construction Workers Welfare Board, if such person falls under any provision of Section 8.
• (3) The decision of the State Government regarding restricting, declaring disqualified, and removing any member under Section 8 shall be final. Manner of Filling 22. Vacancies If a vacancy occurs or is likely to occur in the membership of the Uttarakhand Building and Other Construction Workers Welfare Board, the Secretary shall submit a report to the State Government. Upon receipt of such report, the State Government may, by notification, nominate a person to fill the vacancy, and the person so nominated shall be able to hold office for the remainder of the term of the member in whose place he is nominated. Fees and Allowances 23. of Members.
• (1) The traveling allowance of any government member of the Uttarakhnad Building and Other Construction Workers Welfare Board for a journey performed by him on official duty shall be governed by the rules applicable to him, and it shall be paid by the authority paying his salary.

• (2) The non-official members of the Uttarakhand Building and Other Construction Workers Welfare Board shall be paid fees/travelling allowance for attending the meetings of the Board at such rates as may be fixed by the State Government from time to time. Function of board
• 24. the Uttarakhand Building and Other Construction Workers Welfare Board will perform the functions mentioned in sub-section 6 of Section 7 of the Code. Meeting
• 25. (1) The determination of the place and time of every meeting of the Uttarakhand Building and Other Construction Workers Welfare Board shall be done in accordance with the provisions laid down in the rules made by the Central Government under the Code.
• (2) The Uttarakhand Building and Other Construction Workers Welfare Board shall hold such number of meetings in a year as may be prescribed in the rules made by the Central Government under the Code.
• (3) The special meeting of the Uttarakhand Building and Other Construction Workers Welfare Board shall be called in accordance with the provisions and in the manner prescribed in the rules made by the Central Government under the Code. Chairing the meeting
• 26. The Uttarakhand Building and Other Construction Workers Welfare Board shall be headed by a person specified in the rules made by the Central Government under the Code. Quorum
• 27. No business shall be transacted at any meeting of the Uttarakhand Building and Other Construction Workers Welfare Board unless the meeting has the required number of members as prescribed in the rules made by the Central Government under the Code.

• 28. The notice of every general meeting of the Uttarakhand Building and Other Construction Workers Welfare Board, the notice for calling an emergency meeting and process of determination the list of business for the meeting of the Board shall be in accordance with the provisions laid down in the rules made by the Central Government under the Code. In case of inability of any member to attend the meeting
• 29. In case of inability of any member of the Uttarakhand Building and Other Construction Workers Welfare Board to attend any meeting, Determining the procedure for the appointment of his representative shall be done as per the provisions laid down in the rules made by the Central Government under the Code. Business of Board
• 30. The determination of procedure for the proceedings of the meeting of the Uttarakhnad Building and Other Construction Workers Welfare Board shall be conducted in accordance with the provisions laid down in the rules made by the Central Government in this regard under the Code. Minutes of the meeting
• 31. The procedure for forwarding the minutes of each meeting of the Uttarakhand Building and Other Construction Workers Welfare Board, confirming the minutes and transmitting the minutes to the State Government shall be determined in accordance with the provisions laid down in the rules made by the Central Government under the Code in this regard. • 32. (1) The Secretary to the Uttarakhand Building and Other Construction Workers Welfare Board shall be the Chief Executive Officer of the Board.
• (2) The Secretary to the Uttarakhand Building and Other Construction Workers Welfare Board shall, with prior approval of the Chairperson issue notice to convene meetings of the Board and keep the record of minutes and shall take necessary steps for carrying out the decisions of the Board.

Appointment of Secretary and other officers

• 33. (1) The Uttarakhand Building and Other Construction Workers Welfare Board may, with the prior concurrence of the Government, appoint an officer of the Government, the State Civil Service or not below the rank of a Deputy Labour Commissioner of the Labour Department as Secretary of the Board.
• (2) The Uttarakhand Building and Other Construction Workers Welfare Board may, with the prior concurrence of the Government, appoint,—
• (i) as many officers of the Government, not below the rank of Assistant Labour Commissioner, in the Labour Department; and
• (iii) such other officers and employees of any other department of the Government, as it considers necessary to assist the Board in the efficient discharge of its functions under the Act.
• (3) The structure of employees of Uttarakhand Building and Other Construction Workers Welfare Board and their service conditions shall be determined separately by the State Government. Administrative and financial power of the Secretary.
• 34. (1) The Secretary of the Uttarakhand Building and Other Construction Workers Welfare Board may, without reference to the Board, sanction expenditure and contingencies, supplies and services and purchase of articles, refund for 89 administering the Fund subject to the limits up to which he may be authorised to sanction

expenditure on any single item from time to time by the Board.

• (2) the Secretary may also exercise such other administrative and financial powers other than those specified in sub-rule (1), above, as may be delegated to him from time to time by the Board.
• (3) The Uttarakhand Building and Other Construction Workers Welfare Board may, from time to time delegate, subject to such conditions as it may deem fit, administrative and financial powers to any other officer under its control and supervision to the extent considered necessary for its efficient functioning Supersession and Reorganization
• 35. (1) If the Uttarakhand Building and Other Construction Workers Welfare Board is unable to perform its functions, or, has persistently made delay in the discharge of its functions or has exceeded or abused its powers or jurisdiction, then State Government may, by notification, supersede the Uttarakhand Building and Other Construction Workers Welfare Board: Provided that, before issuing notification of supersession the State Government shall provide reasonable opportunity to the Uttarakhand Building and Other Construction Workers Welfare Board.
• (2) After the supersession of the Uttarakhand Building and Other Construction Workers Welfare Board and until it is reconstituted, the State Government shall make such alternate arrangements for the purpose of administration of the relevant provisions of this Code, as may be prescribed by the Central Government.

• (3) The Uttarakhand Building and Other Construction Workers Welfare Board shall be reconstituted by the State Government in the manner prescribed by the Central Government under Section 11 of the Code.
• (4) A complete report of the proceedings of supersession of Uttarakhand Building and Other Construction Workers Welfare Board and the circumstances leading to its supersession shall be placed before the State Legislative Assembly within three months from the date of notification of supersession. Schemes for building workers
• 36. the welfare schemes mentioned in clauses (c), (d) and (e) of sub-section (6) of section 7 of code, the Uttarakhand Building and Other Construction Workers Welfare Board shall formulate the following schemes for the building workers with the prior approval of the State Government-
• (1) Regarding payment of prescribed amount in connection with premium for Group Insurance Scheme of the beneficiaries;
• (2) frame educational schemes for the benefit of children of the beneficiaries; and
• (3) meet such medical expenses for treatment of major ailments of a beneficiary or his dependant.

Chapter-3

EMPLOYEES INSURANCE COURT Second appeal to 37. Employees’ Insurance Court Under clause (b) of sub-section (7) of section 37 of the Code, the Insured Person or the Corporation, as the case may be, may appeal to the Employees’ Insurance Court by presenting an application within a period of ninety days from the date of the communication of the decision of the medical board or medical appeal tribunal:

Provided that the Employees’ Insurance Court may entertain an application after the period of ninety days, if it is satisfied that the appellant had sufficient reasons for not presenting the application within the said period. Composition Employees Insurance Court and place of sitting

• 38. (1) An Employees Insurance Court under section 48 shall ordinarily consist of one Judge: Provided that State Government may after consultation with the ESI Corporation, by notification in Official Gazette constitute or nominate two or more Judges to a Court for any particular proceeding or clause of proceeding and for such period as may be specified in the notification.
• (2) The Employees Insurance Court shall be subject to the administrative control and superintendence of the High Court of Uttarakhand and shall keep such registers, books, accounts and documents as the High Court may, from time to time prescribe.
• 39. (1) the Employees' State Insurance Court under sub-section (2) of section 50 of the Code shall be presented within twelve months from the date on which the cause of action arose or the claim became payable, as the case may be: Provided that the Court may entertain an application made after the said period of six months if it is satisfied that the applicant has sufficient reason for not making the application within the said period.
• (2) Where at any stage it appears to the Court that the application should be presented to another Court, or should be entertained by the another Court, the first mention shall send the application or file of the case to the Court empowered to deal with it and shall inform the applicant and the

opposite party accordingly and the Court to which application for file is transferred

• (3) The Court shall follow the provisions of the Code of Civil Procedure, 1908 (Act No. 5 of 1908) in respect of issue of summons to the parties, service of summons, procedure of hearing, framing of issues, statement and presentation of evidence, method of recording evidence, cross-examination of witnesses (Code of Civil Procedure) and other related matters.

40. Procedure for filing an application in Employees Insurance Court

• (1) An application under sub-section (1) of section 51 shall be presented in the triplicate in Form A and shall contain the following particulars:
• (b) Full name and description including age, occupation and full postal address of applicant and the opposite party;
• (c) Where the applicant or the opposite party is a minor or a person of unsound mind, a statement to that effect and the full name, age, occupation and full postal address of his or her guardian, next-of-kin, or any other person authorized to act on his or her behalf;
• (d) The fact constituting the cause of action and the date when it arose;
• (e) The facts showing that court has jurisdiction;
• (f) The relief which the applicant claims.

• (2) Every application shall be verified in the same manner as a pleading in a Civil Court.
• (3) All the documents on which the application is based shall be appended to the application with an accurate list thereof
• (4) All applications shall be entered in a register, in the manner as prescribed in Form B, to be maintained by the Court. Fee for filing 41. application before the Employees' State Insurance Court
• (1) The fee payable on an application presented before the Employees Insurance Court in respect of any matter referred to the Code shall be Rs. 100/-.
• (2) The fee and costs payable in respect of any other matters shall be such as prescribed by High Court for subordinate courts.
• (3) All fees and costs referred to in this rule shall be collected by means of Court fee stamps

Chapter-3

Gratuity Gratuity for the 42. benefit of minors In the case of a nominee, or an heir, who is minor, the competent authority referred to in the third proviso of sub-section (I) of section 53 shall invest the gratuity amount deposited with him by the employer for the benefit of such minor in term deposit with the State Bank of India or any nationalised bank. • (1) In section 55 of code, Every employee who has worked for one year prior to the commencement of these rules and has not made a nomination, may submit a nomination in Form I (two copy) within six months from the date of implementation of these rules, which shall be submitted electronically or by registered post with acknowledgement due. appointed after the implementation of the rules, they shall submit the nomination in Form I (two copy) electronically or by registered post with acknowledgement due within six months of completing one year of service. Provided that the employer shall not invalidate a nomination solely on the ground that it was filed after the expiry of six months.

• (2) Within thirty days of the receipt of the nomination in Form I under sub-rule (1), the employer shall obtain the service particulars of the employee as mentioned in the nomination form and verify them from the records of the establishment And after receiving the receipt, it will be returned to the employee.
• (3) An employee who has no family at the time of making a nomination shall, within ninety days of acquiring a family submit in the manner specified in sub-rule (1), a fresh nomination, as required under sub-section (4) of section 55, duplicate in Form-I to the employer and thereafter the provisions of sub-rule (2) shall apply mutatis mutandis as if it was made under sub-rule (1).
• (4) A notice of modification of a nomination, including cases where a nominee predeceases an employee, shall be submitted in duplicate in Form-I to the employer in the manner specified in sub-rule (1), and thereafter the provisions of sub-rule (2) shall apply mutatis mutandis as if it was made under sub-rule (1).
• (5) A nomination or a fresh nomination or a notice of modification of nomination shall be, signed by the employee or, if illiterate, shall bear his thumb impression in the presence of two competent witnesses, who shall also sign a declaration to that effect in the nomination, fresh nomination or notice of modification of nomination and shall be submitted by the employee electronically or by

registered post acknowledgement due to the employer.

• (6) A nomination, fresh nomination or notice of modification of nomination shall take effect from the date of receipt thereof by the employer. Written application for gratuity

Under sub-section (1) of Section 56 An employee eligible for the payment of gratuity under the Code, or any person authorized in writing by the employee to act on their behalf, shall ordinarily apply to the employer in Form II within thirty days from the date the gratuity becomes payable; provided that the application may be made even after thirty days if there is a reasonable cause for the delay. Provided further that an employee may apply to the employer even thirty days prior to the date of their retirement. Application to the Competent Authority
• 45. under clause (b) of sub-section (5) of Section 56, If there is any dispute regarding the amount of gratuity, the admissibility of the claim, or eligibility, the employer, employee, or authorized person may apply to the Competent Authority in the prescribed Form III for the decision of the dispute. Chapter-5

Maternity Benefit

Appellate authority against the order of the Inspector-cum- Facilitator 47. Any person aggrieved by a decision made by the Inspector-cum-Facilitator under sub-section (2) of section 72 of the Code may, within 30 days of the receipt of such order, prefer an appeal to the Appellate Authority. The Appellate Authorities shall be notified by the State Government, who shall be of the rank of Joint Labour Commissioner/ Additional Labour Commissioner.

Chapter-6

Employee's Compensation

Amount to be deposited by the employer with the competent authority for the funeral expenses of the employee 48. If death results from the injury caused to the employee, the employer shall, in addition to the compensation under sub-section (1) of section 76, hand over a sum of fifteen thousand rupees to the eldest surviving dependent of such employee for the funeral expenses of the employee before the Competent Authority, or where the employee has no dependent or was not living with his dependents at the time of his death, to the person who actually incurred the funeral expenses, for payment: Provided that if the Central Government increases the amount specified in sub-section (7) of section 76, the State Government shall comply with the same. Conditions for review without certificate of medical practitioner 49. Under sub-section (1) of Section 79 Of code, a review of such half-monthly payments payable under this Code, under any agreement between the parties or under the order of the Competent Authority, may be applied for by the Competent Authority either on the application of the employer or the employee, accompanied by a certificate from a medical practitioner (who shall be registered with the

• 50. Under sub-section (4) of Section 82, the employer shall maintain an information booklet according the format prescribed in Form-IV in their premises where the employee is employed, which shall be easily accessible to the officers/employees working in the premises at reasonable times. Medical examination
• 51. Under sub-section (1) of Section 84 of code, where an employee has given notice of an accident, if the employer, before the expiry of three days from the time when the notice was served, requests that he be examined by a medical practitioner, he shall submit himself for such examination; and any employee who receives half-monthly payments under the sections of this Code shall, if so required, submit himself for such examination from time to time: provided that he shall not be required to submit himself for medical examination more than twice in the first six months after the accident and more than twice in a year thereafter. • 52. Under sub-section (1) of section 88 of the Code, if the competent authority receives information from any source that a workman has died as a result of an accident occurring in the course and in the course of his employment, a notice shall be sent by the competent authority to the employer of such employee and a copy of notice shall be sent by the competent authority to the dependents of the employee by registered post or electronic mail. Within 30 days of the service of such notice, the employer of the employee shall send a information to the competent authority by registered post or by electronic mail in the prescribed format in Form-V, stating the circumstances in which the death of the employee has occurred and indicating whether in the opinion of the employer he is liable to pay compensation on account of such death or not.

Manner of recording memorandum in the register by the Competent Authority 53. Under sub-section (1) of Section 89 of code, where any lump sum amount payable as compensation, whether by way of agreement or as redemption of half-monthly payments, or compensation where any compensation has been so settled that it is payable to a woman or a person under a legal disability, a memorandum thereof shall be sent by the employer to the Competent Authority, who shall, on being satisfied as to its genuineness, register the memorandum in the register electronically or manually, which shall be in Form VI-(A), Form VI-(B), and Form VI-(C)— Provided that—

• (I) No such memorandum shall be recorded by the Competent Authority before seven days after the communication of notice to the parties concerned;
• (II) The Competent Authority may at any time rectify the register;
• (III) Where it appears to the Competent Authority that an agreement as to the payment of a lump sum, whether by way of redemption of a half-monthly payment or otherwise, or an agreement as to the amount of compensation payable to a woman or a person under a legal disability, ought not to be registered by reason of the inadequacy of the sum or amount, or by reason of the agreement having been obtained by undue influence or improper means, he may refuse to record the memorandum of the agreement and may make such order, including an order as to any sum already paid under the agreement, as he thinks just in the circumstances.
• (IV) For recording the memorandum of agreement, the Competent Authority shall cause its entry in a register under Form VII. Experience qualifications appointment

and for as 54. Under sub-section (1) of Section 91 of code The State Government may, by notification, appoint any person

Competent Authority who is not below the rank of Assistant Labour Commissioner and has 05 years of experience as the Authority, or a Deputy Labour Commissioner shall be specified in the notification as the Competent Authority for this purpose. Provided that such experience mentioned above is not required for the appointment of any person as a Competent Authority who has worked as a Conciliation Officer for five years. 55. (1) Under sub-section (1) of Section 92 of code Where any matter is to be done by or before a Competent Authority under this Chapter, it shall, subject to the provisions of this Chapter, be done by the Authority for the area in which:—

• (a) The accident took place which resulted in the injury; or
• (c) The registered office of the employer is situated. Provided that in any case, no Competent Authority other than the Competent Authority having jurisdiction over the area where the accident took place shall proceed without giving notice electronically or by registered post to the Competent Authority having jurisdiction over that area and to the State Government. Provided further that where the employee is a master or seaman of a ship or a captain or a member of the crew of an aircraft or an employee of a motor vehicle or a company, and meets with an accident outside India, any such thing may be done by or before the Competent

Authority of the area in which the owner or agent of the ship, aircraft, or motor vehicle, as the case may be, resides or carries on business or where the registered office of the company is situated.

• (2) If on receipt of an application, it appears to the Competent Authority that the said application should have been presented to another Competent Authority, he should return it to the applicant, stating the reasons along with the date of presentation and return, mentioning the designation of the Competent Authority to whom it should have been presented.
• (3) The Competent Authority to whom the said case has been transferred shall continue the proceedings as if all previous proceedings had been taken before him, if he is satisfied that it will not adversely affect the interests of the parties.
• (4) The Competent Authority, after considering the application, may summarily dismiss the application if, for reasons to be recorded, he is of the opinion that there are no sufficient grounds for proceeding thereon.
• (5) If the application is not dismissed by the Authority, he shall issue a summons to the respondent along with a copy of the enclosed application and other records.
• (6) If the respondent wishes to contest the claim, he shall file a written statement along with the records, and if he fails to do so, the Competent

• (7) If the respondent files a written statement, the claimant may file his reply.
• (8) The Competent Authority may require the parties to file their respective evidence on affidavit, upon which the opposing party shall have the right to cross-examine.
• 56. (1) An application of any nature referred to in Under Section 93 may be sent to the Competent Authority electronically or by registered post or may be given to him or to his subordinate officers authorized by him in this behalf, and an application so sent or presented shall be attempted to be disposed of within 06 months, after which a hearing shall be held every 07 days: provided that this time limit shall not exceed one year.
• (2) The incidental expenses of every such application shall be one percent of the total amount (claimed by the applicant) as litigation costs, provided that if in any case the applicant is unable to make advance payment of the fee for any reason, the Competent Authority may decide to accept the payment of the fee after the final disposal of the case.
• (3) Any party to the dispute who wishes to obtain a certified copy of the file or any part thereof may obtain it by paying five rupees per page and twenty rupees for a copy of the application.

Manner of authentication of memorandum 57. Under Section 97 of the Code, as and when each witness is examined, a brief memorandum containing the substance of the evidence of that witness, containing the name, address, date and time of the witness, shall be prepared by the competent authority, His statement shall be taken verbatim and authenticated by a witness and his authorized representative. Such memorandum shall be authenticated by the competent authority under his own hand and such memorandum shall form part of the record. Provided that the evidence of any medical witness shall be written verbatim as may be possible.

Chapter-7

Social Security and Cess in relation to Building and Other

Construction Workers Time limit for payment of cess amount 58. Any amount of cess under Section 100 of the Code shall be deposited by the employer before the Competent Authority within thirty days. If the employer fails to make the payment within thirty days, such employer shall be liable to pay interest on the amount of cess to be paid, for such period from the date on which such payment fell due until the actual realization of the amount, at such rate as may be prescribed by the Central Government. Fee for appeal 59. (1) Any employer aggrieved by an order of assessment made under section 103 or an order imposing a penalty made under section 104 may, file an appeal under section 105 of the Code within such time period as may be prescribed the Central Govt. Under sub-section (2) of Section 105, a fee of 10 thousand rupees on cess up to 20 lakh rupees and a fee of 20 thousand rupees on cess above 20 lakh rupees with every appeal shall have to be filed.

• (2) The appeal fee shall be liable to be forfeited in the event of the appeal being dismissed.

Chapter-8

Finance and Accounts

• 61. Where Unorganized Workers Social Security Board is of the opinion that the amount of contribution, cess, interest and damages due to board has become irrecoverable, the Board or any other officer authorized by it in this behalf may sanction the writing off of the said amount, subject to the following conditions, namely:—
• (i) Establishment has been closed for more than five years and the whereabouts of the employer cannot be ascertained, despite all possible efforts;
• (iii) Claim for contribution is not fully met by—
• (a) The Official Liquidator in the event of factories/establishments having gone into liquidation; or
• (b) In the event of unit being nationalized or taken over by the Government

Chapter-9

Authorities, Assessment, Compliance and Recovery

Other powers of the Inspector-cum- Facilitator

• 62. In addition to the powers of the Inspector-cum-Facilitator conferred under sub-section (6) of Section 122 shall exercise such other powers and perform such other duties as the State Government may implement by general or special order. Form and manner of maintenance of records and registers, etc.
• 63. (a) Every employer shall maintain the register of employees, attendance and muster roll register, details of wage deduction fines and their recovery, register of women employees in the prescribed form under the Uttarakhand Wage Code Rules, 2026.
• (b) Under this chapter, all registers shall be maintained either in electronic form or in manual form, and all entries shall be made in Hindi or English language.
• (c) Every employer shall provide the records and registers whenever required by inspector-cum-facilitator or any authority.
• (d) The details of the cess given in relation to building and other construction work shall also

be kept safely, which shall be produced when demanded by the authority.

• (e) All registers and other records shall be preserved in original for a period of five calendar years from the date of the last entry.
• (f) Every employer shall provide a wage slip to employees, in the prescribed form under the Uttarakhand Wage Code Rules 2026, either electronically or manually, at least 24 (twenty-four) hours before the payment of wages, in accordance with Clause (c) of Section 123 of the Code.
• (g) In respect of the said establishment where maintenance of registers is required under the rules made under the Code on Wages, 2019 or under the Occupational Safety, Health and Working Conditions Code, 2020, the employer shall maintain the register of employees, register of attendance and muster roll, register of wages, overtime and deductions, and wage slips under those Codes and the rules made thereunder.
• (h) All registers and records required to be maintained under this Code and its rules shall be kept within the limits of the workplace and all records relating to any employee shall be made available to him when demanded by the employee.
• (i) The employer shall, before 31 March every year, while providing information regarding the specified particulars relating to the preceding year, upload the unified annual return online in

prescribed form on the website of the Labour Department and shall produce it when demanded by the authority.

Chapter-10

Offences and Penalties

Form and manner of application for compounding of offence 64. For the purpose of compounding offences under sun- section (1) of section 138 of the code, the Person to whom a notice has been issued for compoundable offences under section 138 shall apply electronically in Form-VIII to the officer authorized by the State Government and within 15 days from the date of receipt of the notice, the person shall deposit the compounding amount either electrically or in person.

Chapter-11

Miscellaneous

Sources of Social Security Funds 65. Under sub-section (5) of section 141 of the Code, A Social Security Fund shall be established for the welfare of unorganised workers, in which the amounts received from the following shall be deposited:—

• I. Amounts received from the compounding of offences under this Code.
• II. Amounts provided by the State Government for the establishment of the fund.
• III. Grant amounts provided by the Government of India, the State Government, and other authorities.
• IV. Amounts of contribution received from the registration/renewal of persons seeking registration.
• V. Amounts received for the implementation of schemes notified by the Government of India.

• (1) The entire fund shall be kept in a separate account in any nationalized banks.
• (2) The fund will be utilized for the scheme prepared and notified by the Uttarakhand Unorganized Workers Social Security Board with the prior approval of the State Government for the welfare of the unorganized workers registered as beneficiaries and their families.
• (3) The audit of the accounts of the fund shall be conducted in accordance with the instructions issued by the State Government from time to time. Uploading on the official website of the department

• 68. (1) Uttarakhand (Uttar Pradesh Maternity Benefit Rules, 1983) Adaptation and Modification Order, 2002, Uttarakhand (Uttar Pradesh Payment of Gratuity Rules, 1975) Adaptation and Modification Order, 2002, Uttarakhand Building and Other Construction Workers (Regulation of Service Conditions of Employment) Rules, 2005, Unorganized Workers Social Security Rules, 2011 shall be

Memorandum of Agreement

It is hereby submitted that on date ---------------- personal injury was caused to employee ----------------, Aadhaar No. ----------------, Mobile No. ----------------, Employee Code ----------------, Resident of ------------------- arising out of and in the course of employment in the establishment -----------------. As a result of the aforesaid injury, the said employee has suffered temporary disability, whereby it is estimated that he/she will be unable to earn more than his/her previous/any wages for a period of ---------------- months. Under Sub-section (1) of Section 89 (Rule-53)

Memorandum of Agreement It is hereby submitted that on date ------------------------ personal injury was caused to ------------------------, resident of ------------------------ arising out of employment in the establishment ------------------------. As a result of the aforesaid injury, the said employee has suffered temporary disability and is currently receiving/not receiving monthly wages of ₹ ------------------------. The estimated monthly wages of the said employee prior to the accident were ₹ ------------------. The said employee is under a legal disability due to -------------------------------. It is further submitted that the employer of the said employee has agreed to make half-monthly payments at the rate of ₹ --------------------------- for the period of the aforesaid temporary disability, and the said employee has agreed to accept the payment. The agreement is made subject to the condition that the amount of half-monthly payment may be varied in accordance with the provisions of the Code on Social Security, 2020, should there be a change in the earnings of the said employee during the period of disability. It is further settled that all rights of commutation under Section 80 of Chapter VIII of the said Code shall remain unaffected by this agreement.
